 Terms and Conditions of the Online Store

1. General Provisions, Contact Details

These Terms and Conditions (hereinafter referred to as the “Terms”) define the rules for using the online store Gifts Of The Universe, available at: https://giftsoftheuniverse.pl.

The owner of the Store is Weronika Madeja, a sole trader operating under the business name Gifts Of The Universe, with its registered address at: Jagiellońskie 27/9, 31-835 Kraków, Poland, registered in the Central Register and Information on Economic Activity (CEIDG), NIP: 6783193595 (hereinafter referred to as the “Seller”).

2. Technical Requirements

To use the Store, the following are required:

  • a computer or other device with a web browser;

  • Internet access;

  • an active email address.

3. Personal Data

The Seller is the controller of customers’ personal data.

Detailed information regarding the processing of personal data can be found in the Privacy Policy.

4. Conclusion of the Sales Agreement, Customer Account

The Store allows the purchase of products (hereinafter referred to as “Products”) displayed on the Store’s website in two ways:

  • without registration;

  • by creating a customer account.

In both cases, to place an order, the customer must select Products, add them to the “Cart,” and proceed through the checkout process by selecting delivery and payment options.

Product descriptions and prices constitute an invitation to conclude a sales agreement within the meaning of Article 71 of the Polish Civil Code.

To place an order, the customer must provide all required data necessary for delivery and, optionally, invoice details.

Creating an account (“Account”) is a one-time process. The email and password chosen by the customer will be used for future logins. Logged-in users can view order history and place orders without re-entering their details.

The customer may delete their Account at any time free of charge by contacting: giftsoftheuniversehandmade@gmail.com.

By clicking the “Buy and Pay” button, the customer:

  • submits an offer to purchase Products in accordance with these Terms;

  • accepts the obligation to pay for the Products and delivery costs.

The sales agreement is concluded once the Seller confirms the order via email.

If the order cannot be fulfilled (in whole or in part), the Seller will inform the customer. In such a case, no agreement is concluded. Any payments made will be refunded.

The Seller provides confirmation of the agreement on a durable medium at the latest upon delivery.

The Store is not responsible for delivery issues caused by incorrect or incomplete customer data.

The Seller reserves the right to suspend order processing if the provided data is incorrect or raises doubts.

5. Prices and Payment Methods

All prices are in Polish złoty (PLN) and include VAT.

Delivery costs are shown separately in the cart.

Available payment methods:

  • Visa and Mastercard

  • Shoper Payments

  • Autopay S.A

  • Przelewy24

  • Stripe

  • InPost Pay

  • Klarna

If an online payment method is selected, payment must be made on the same day. Otherwise, the order will be automatically cancelled.

This does not apply to deferred or installment payments offered via external providers.

6. Delivery and Order Fulfillment Time

Delivery methods:

  • Polish Post

  • InPost parcel lockers

An order is considered fulfilled when it is handed over to the carrier.

Delivery time is determined by the carrier.

Products are shipped within 7–14 business days. The exact processing time is always stated in the product description.

The Seller processes orders within Poland. International shipping is available at costs shown on the website or agreed individually.

7. Right of Withdrawal

Consumers and privileged entrepreneurs have the right to withdraw from the contract within 14 days of receiving the Product, without giving any reason.

To exercise this right, the customer must submit a statement:

The customer must return the Products within 14 days at their own cost to parcel locker KRA41M.

The Seller will refund:

  • the Product price;

  • the cost of the cheapest standard delivery option.

The refund will be made within 14 days.

The Seller may withhold the refund until the Product is returned or proof of return is provided.

Refunds will be made using the same payment method unless agreed otherwise.

The customer is liable for any diminished value of the Product resulting from use beyond what is necessary.

8. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • personalized products;

  • perishable goods;

  • sealed goods opened after delivery for hygiene reasons;

  • audio/video/software products in sealed packaging once opened;

  • goods inseparably combined with other items;

  • newspapers and magazines (excluding subscriptions);

  • goods dependent on financial market fluctuations;

  • alcoholic beverages with delayed delivery.

9. Complaints

The Seller is obliged to provide Products in conformity with the contract.

Complaints may be submitted:

Complaints will be processed within 14 days.

Customers may use out-of-court dispute resolution methods, including:

  • mediation via Trade Inspection

  • consumer ombudsman assistance

  • ODR platform (Online Dispute Resolution)

  • consumer arbitration courts

10. Final Provisions

Polish law applies. The contract is concluded in Polish.

Nothing in these Terms limits consumer rights under applicable law.

The Seller may amend these Terms. Changes apply to future orders.

XI. DISCOUNT CODES

Each discount code is valid until the end of the year in which it was issued, unless stated otherwise.

**Account Terms and Conditions

Gifts Of The Universe**

1. General Provisions

These Account Terms define the rules for using a customer account in the Store.

The Account service is free of charge and supplementary to the Store.

2. Functionality

With an Account, the customer can:

  • store personal data and delivery address;

  • view order history;

  • track order status.

3. Agreement and Cancellation

Creating an Account means concluding an indefinite service agreement.

The customer may delete the Account at any time.

The customer also has the right to withdraw within 14 days.

4. Complaints

Complaints follow the same procedure as in the Store Terms.

5. Personal Data

Full details are available in the Privacy Policy.

6. Changes

The Seller may amend the Account Terms.

If not accepted, the customer may terminate the agreement with 14 days’ notice.
